Terms of Service
Welcome to 48 Social
48 Social exists to help creators, entrepreneurs, and organizations grow their impact through authentic communication, intelligent technology, and effective systems.

If you are accepting these Terms on behalf of an organization, you represent that you have the authority to bind that organization.

If you are under 18, you must have permission from a parent or legal guardian. Where required, the parent or guardian must accept these Terms and assume responsibility for contractual obligations and payment.

You agree to:
- Use strong, unique passwords.
- Maintain accurate account and billing information.
- Avoid sharing credentials with unauthorized persons.

Connected Accounts
When connecting a social media or other external account, you authorize 48 Social and its approved service providers to access that account within the permissions you grant.
Supported integrations use account authorization mechanisms such as OAuth.
You must have the legal authority to connect and manage each account.
Authorized 48 Social personnel may assist with managing connected accounts where you have granted permission and such access is permitted by the relevant platform.
We will not intentionally access or publish through your accounts outside the scope of your authorization.
You may revoke integration permissions through supported account settings or the relevant third-party platform.
You must not attempt to bypass account security systems or provide access to accounts you do not own or have authority to manage.
4. Content Ownership and Intellectual Property
Your Content Belongs to You
You retain ownership of the original content, materials, and intellectual property you submit to 48 Social.
This includes your original:
- Written material and creative work.
- Images, photographs, video, and audio.
- Brand assets, designs, and messaging.
- Documents, testimonials, and promotional materials.
- Customer information and other business records.
We do not claim ownership of your original work merely because it is uploaded to or processed through the Services.
AI-Generated Content
You may use AI-generated outputs for your lawful personal or business purposes, subject to applicable law, provider terms, and third-party rights.
Ownership and copyright protection of AI-generated material may vary by jurisdiction and the degree of human authorship involved.
AI-generated outputs may not be unique, and similar outputs may be generated for other users.
We do not guarantee that AI-generated material is eligible for copyright protection or free from third-party intellectual property claims.
Limited License to Provide the Services
You grant SpiritualTech Systems and its authorized service providers a limited, nonexclusive license to access, host, reproduce, process, adapt, transmit, and, when you authorize publication, publish your content as reasonably necessary to provide the Services.
This permission includes processing through authorized AI tools and integrated services.
We do not acquire ownership of your content through this license.
We will not use your private customer content in our public advertising or marketing without appropriate additional permission.
Our Intellectual Property
48 Social, SpiritualTech Systems, and their licensors retain ownership of their respective software, designs, branding, documentation, systems, workflows, proprietary methods, and other intellectual property.
Your subscription provides a limited, revocable, nonexclusive, nontransferable right to use the Services in accordance with these Terms.
It does not grant ownership of the underlying technology, licensed software, AI models, proprietary automations, templates, or internal processes.
You may not copy, redistribute, reverse engineer, resell, or commercially exploit protected platform technology except as expressly authorized or permitted by law.
5. AI Use and Responsible Technology
48 Social uses artificial intelligence to support human creativity, communication, and productivity.
Our philosophy is that technology should help people express themselves authentically and meaningfully.
Human Responsibility
You are responsible for reviewing AI-generated material before relying on or publishing it.
AI systems can generate inaccurate, misleading, incomplete, biased, or otherwise unsuitable results.
You agree to exercise appropriate judgment and verify factual claims, legal statements, testimonials, and other consequential content.
No Misleading or Low-Quality Mass Automation
We are committed to fostering meaningful, authentic communication rather than manipulative, repetitive, or deceptive content.
You may not use the Services to:
- Generate or distribute spam.
- Publish misleading claims or fabricated testimonials.
- Impersonate individuals or organizations deceptively.
- Create fraudulent or deliberately misleading AI-generated media.
- Artificially manipulate engagement metrics.
- Circumvent social platform safeguards.
- Conduct unauthorized mass scraping or automated interactions.
- Publish content that violates applicable laws or platform policies.
AI assistance is welcome. Deception, exploitation, and prohibited automation are not.
We may restrict or suspend uses that violate these standards.
Third-Party AI Tools
Certain features rely on independent AI providers.
Information submitted to these features may be processed by those providers as described in our Privacy Policy.
AI providers may differ in how they handle submitted data, including retention and model-training practices.
Users should avoid submitting sensitive or confidential information unless the relevant feature and its safeguards are suitable for that information.
You are responsible for ensuring you have the necessary rights and permissions to submit materials for AI processing.
6. Social Media Publishing and Platform Compliance
48 Social Studio is designed to support authorized, user-directed social media publishing.
User Approval
Users must approve each post before it is scheduled or published through the standard 48 Social Studio workflow.
Once approved, a post may be published automatically at its scheduled time through the authorized integration.
Approval applies to the content, account, and intended publishing action selected by the user.
48 Social personnel assisting with content management must operate within the permissions granted by the customer.
Social Platform Requirements
You agree to comply with all applicable terms, developer rules, content policies, intellectual property requirements, and community standards of connected platforms, including Meta platforms and Pinterest.
You must not use 48 Social to evade platform rules, exploit unauthorized interfaces, or engage in prohibited automated behavior.
You authorize us to decline or restrict publishing activity where necessary to comply with applicable laws, platform requirements, or security obligations.
Platform Independence
Social media platforms operate independently from 48 Social.
We do not guarantee that a connected platform will:
- Approve or publish every requested post.
- Maintain uninterrupted API access.
- Preserve a particular algorithm, integration, or feature.
- Deliver a particular level of reach, engagement, or income.
- Avoid restricting an account for activity outside our control.
You remain responsible for maintaining your social accounts in good standing.
7. Customer Responsibilities for Business Communications
Customers using 48 Social Systems to communicate with their own contacts are responsible for their marketing and communication practices.
This includes responsibility for:
- Collecting information lawfully.
- Providing appropriate privacy disclosures.
- Obtaining required email, SMS, or marketing consent.
- Maintaining evidence of consent when required.
- Honoring unsubscribe and opt-out requests.
- Complying with applicable telemarketing and electronic communications laws.
- Maintaining accurate and lawful customer records.
- Protecting information about their own customers.
Where applicable, customers must comply with email marketing laws, telecommunications regulations, messaging-provider requirements, and relevant privacy laws.
You may not use the Services for unlawful unsolicited messaging, phishing, fraud, or abusive campaigns.
Use of SMS and calling features may require additional registration, identity verification, or approval from messaging providers.
We may suspend noncompliant communication activity to protect customers, recipients, service providers, and the integrity of the platform.
8. Privacy and Data Protection
Our collection and use of personal information are described in the 48 Social Privacy Policy.
For personal information that customers collect or manage through 48 Social Systems, customers generally determine the purposes of processing and are responsible for their own privacy notices, lawful bases, and handling of individual privacy requests.
Where applicable, SpiritualTech Systems and its technology providers process that information to provide the Services under relevant contractual and data protection arrangements.
Customers must not upload or process personal information they are not legally entitled to collect or use.
A separate Data Processing Addendum may apply where required by law or agreed between the parties.
9. Third-Party Providers and Integrations
48 Social works with independent technology and service providers, including providers of:
- AI and large language models.
- Business management software.
- Social media integrations.
- Scheduling and publishing tools.
- Hosting and infrastructure.
- Payment processing.
- Email and SMS delivery.
- Analytics and advertising services.
We select our providers with consideration for their functionality, reliability, security, and suitability for the Services.
However, independent providers control their own systems, policies, and operations.
Your use of particular integrations may require acceptance of additional provider terms.
We are not responsible for independent third-party conduct or outages beyond our reasonable control, except as required by applicable law or our contractual obligations.
We may replace or discontinue integrations when necessary for security, compatibility, compliance, or service improvement.
10. Subscriptions, Payments, and Usage Charges
48 Social Studio and 48 Social Systems are separate products and may have separate subscription plans, billing arrangements, and charges.
Subscription Billing
Unless otherwise stated at checkout:
- Subscription charges are billed in advance.
- Monthly and annual subscriptions automatically renew for successive billing periods until canceled.
- The applicable subscription price, billing frequency, and material conditions are disclosed during purchase.
- You authorize us or our payment providers to collect applicable recurring charges.
- Applicable taxes and separately disclosed fees may be added.
Usage-Based Fees
Certain services, especially within 48 Social Systems, may include additional usage-based charges.
These may include SMS, calls, email delivery, AI processing, third-party integrations, or other metered services.
Applicable usage rates and billing methods will be disclosed through the relevant plan, order, account interface, or service agreement before charges are incurred.
Usage-based fees may be billed separately from subscription fees.
Trials, Promotions, and Setup Fees
Free trials, introductory offers, onboarding fees, and setup charges may be available under separately disclosed terms.
Any automatic conversion from a trial to a paid subscription will be disclosed before enrollment, with consent obtained as required by law.
Cancellation
You may request cancellation at any time by emailing [email protected] or using an available account cancellation feature.
For emailed cancellation requests, we ask that you contact us at least 72 hours before your next billing date, when possible, to allow time for processing.
This notice request does not override any right to cancel sooner or through an online cancellation method where required by applicable law.
Cancellation normally takes effect at the end of the current paid subscription period unless applicable law or a specific agreement provides otherwise.
Cancellation stops future subscription renewals but does not eliminate valid charges already incurred, including applicable usage charges.
Disconnecting a social media integration does not itself cancel a paid subscription.
Refunds
Subscription and usage charges are generally non-refundable except where required by law or expressly stated in an applicable offer.
We understand that circumstances change.
If you experience a billing concern, please contact [email protected]. We will review the situation in good faith and make reasonable efforts to find a fair resolution.
Price Changes
We may update subscription prices or usage rates with notice as required by applicable law.
Any increase affecting a recurring subscription will be communicated and implemented in accordance with applicable disclosure, consent, and cancellation requirements.
11. Acceptable Use
You agree not to use 48 Social for unlawful, abusive, deceptive, or unauthorized purposes.
Prohibited activities include:
- Violating laws, regulations, or third-party platform policies.
- Infringing copyright, trademark, privacy, or publicity rights.
- Uploading material you have no authority to process.
- Sending unlawful or unsolicited commercial communications.
- Distributing malware, phishing messages, or fraudulent content.
- Accessing another person's account without permission.
- Circumventing security or authorization controls.
- Scraping, manipulating, or automating social platform activity in violation of applicable rules.
- Creating fraudulent testimonials or misleading endorsements.
- Engaging in unlawful harassment, exploitation, or discriminatory abuse.
- Attempting to compromise the security or availability of the Services.
- Reselling or sublicensing platform access without authorization.
We may investigate suspected violations and take proportionate action, including restricting features, removing prohibited content, or suspending accounts.
Where appropriate and legally permitted, we may provide an opportunity to resolve violations before termination.
12. Customer Content and Testimonials
You are responsible for content you submit, approve, and publish.
You represent that you have the necessary rights, licenses, authorizations, and consents for all materials you provide.
When uploading testimonials, reviews, photographs, videos, or recordings involving other people, you must obtain any required permissions and ensure that the material is used lawfully.
Testimonials and endorsements must accurately represent genuine experiences and comply with applicable advertising disclosure requirements.
We do not claim the right to use your uploaded testimonials or private promotional materials in our own marketing without appropriate authorization.
13. Confidentiality and Proprietary Information
Both 48 Social and its customers may share confidential or proprietary information while working together.
Each party agrees to use confidential information received from the other only for legitimate purposes related to the Services, unless otherwise authorized or legally required.
Confidential information may include:
- Private customer and business records.
- Nonpublic technical documentation.
- Proprietary workflows and methods.
- Internal systems and technical processes.
- Confidential commercial information.
- Nonpublic materials explicitly identified as confidential or reasonably understood to be confidential.
Neither party obtains ownership of the other's preexisting proprietary information merely through access, training, collaboration, or service delivery.
Separate agreements may establish additional confidentiality obligations.
14. Service Availability and Modifications
We work to provide reliable and useful Services.
However, software platforms depend on infrastructure, integrations, networks, and independent technology providers.
Temporary interruptions, technical issues, scheduled maintenance, or integration changes may occur.
We may modify the Services to maintain security, comply with legal requirements, improve functionality, or address provider changes.
Where reasonably practicable, we will provide advance notice of material changes that significantly affect paid features.
Nothing in this section limits mandatory consumer rights or specific service commitments made in a separate agreement.
15. No Guarantee of Results
48 Social provides tools and services intended to support creativity, communication, and business operations.
We do not guarantee:
- Specific social media reach or engagement.
- Follower growth or audience conversion.
- Revenue, profits, or financial outcomes.
- Search rankings or advertising performance.
- Accuracy of all AI-generated content.
- Continuous access to third-party platforms.
- Uninterrupted availability of every feature.
Your results depend on many factors, including your content, strategy, market conditions, platform rules, and actions.
AI tools support human judgment; they do not replace it.
16. Suspension and Termination
You may stop using the Services and request account closure by contacting support.
We may suspend or terminate access when reasonably necessary because of:
- Material violations of these Terms.
- Nonpayment of valid charges.
- Security threats or suspected account compromise.
- Illegal or prohibited activities.
- Mandatory legal or third-party platform requirements.
Where appropriate, we may provide notice and a reasonable opportunity to resolve a problem.
Upon termination, your right to use the affected Services ends.
You are responsible for requesting or exporting available content and business records before account closure.
We will handle remaining personal information according to our Privacy Policy, applicable data protection agreements, and legal obligations.
Information already published to third-party services may remain subject to those platforms' rules.
17. Disclaimers
To the maximum extent permitted by applicable law, the Services are provided on an "as is" and "as available" basis.
SpiritualTech Systems disclaims implied warranties to the extent permitted by law, including implied warranties of merchantability, fitness for a particular purpose, and noninfringement.
This disclaimer does not exclude warranties or rights that cannot legally be excluded.
We remain responsible for obligations expressly undertaken in applicable agreements and for liabilities that cannot lawfully be disclaimed.
18. Limitation of Liability
To the maximum extent permitted by law, SpiritualTech Systems will not be liable for indirect, incidental, special, consequential, or punitive damages arising from the Services, including lost profits, business opportunities, or anticipated savings.
To the extent permitted by law, our aggregate liability for claims related to a particular paid Service will not exceed the amount paid to SpiritualTech Systems for that Service during the 12 months preceding the event giving rise to the claim.
For free Services, liability will be limited to the extent permitted by applicable law.
These limitations do not apply where prohibited by law, including liabilities that cannot be excluded or restricted under applicable consumer protection law.
19. Responsibility for Third-Party Claims
You are responsible for the lawfulness of content you submit and actions you authorize through the Services.
To the extent permitted by law, if a third party makes a claim against SpiritualTech Systems arising from your unlawful content, willful misconduct, or material breach of these Terms, you agree to indemnify SpiritualTech Systems against reasonably incurred resulting losses, damages, and expenses, excluding amounts attributable to our own wrongdoing.
Nothing in this section limits rights that cannot be waived under applicable consumer law.
20. Dispute Resolution and Governing Law
We believe concerns should be handled fairly, respectfully, and in good faith.
If you experience a problem, contact [email protected] so we can attempt to resolve it directly.
For unresolved disputes, these Terms are governed by the laws of California, United States, excluding conflict-of-law rules, except where mandatory consumer protection laws require otherwise.
Subject to mandatory jurisdiction requirements, legal proceedings may be brought before courts with jurisdiction in San Mateo County, California.
The parties may agree to mediation or another voluntary dispute resolution process.
These Terms do not require mandatory binding arbitration.
21. Changes to These Terms
We may update these Terms to reflect changes in our Services, technology, operations, or applicable law.
Material changes will be communicated through an appropriate method, such as email, account notification, or a notice on our website.
Where legally required, we will obtain your agreement before amended terms become effective.
Continued use after properly notified changes take effect may constitute acceptance to the extent permitted by applicable law.
22. General Provisions
Entire Agreement: These Terms, together with the Privacy Policy and any applicable subscription agreement, order form, or Data Processing Addendum, govern your use of the relevant Services.
Separate Agreements: A separately signed service agreement may establish additional or different responsibilities for implementation, consulting, custom development, or managed services.
Severability: If a provision is unenforceable, the remaining provisions continue in effect.
No Waiver: Failure to enforce a provision does not waive the right to enforce it later.
Assignment: You may not transfer contractual rights or obligations without our written consent, except where applicable law permits otherwise. We may assign these Terms in connection with a lawful organizational restructuring or transfer, subject to applicable notice and legal requirements.
Independent Providers: Third-party technology providers remain independent organizations. Use of their technologies does not create an ownership relationship between SpiritualTech Systems and those providers.
